May Program

The first ever Richard Linn American Inn of Court Linn "Linn Inn Advocacy Challenge" was held at our May Program meeting on May 12 (Monday) at 5:30 pm in the ceremonial courtroom at the Everett McKinkley Dirksen Building.

A reception hosted by Niro, Scavone, Haller & Niro was held immediately after the program at the Union League Club.

Two teams argued an appeal before Chief Judge Holderman, Circuit Judge Linn and Judge Kennelly. Jamal Edwards and Adam Greenfield coached by Pupilage Group 2 (headed by Jerry Jacover) represented Jerry Jacover. Amy Crout Ziegler and Julie Leichtman coached by Pupilage Group 3 (headed by Craig Fochler) represented the Chicago Cubs.

Topic-Copyright "Fair Use" Doctrine
Guest Speaker, Gordon Quinn of Kartemquiun Films in Chicago, spoke on the doctrine of "fair use" in copyright law..

He showed several uses of copyrighted material in his own documentary works, and we considered why the examples should or should not be considered "fair use."

Gordon is a documentary filmmaker. One of his most notable films is "Hoop Dreams." Gordon's experience in litigation has heightened his awareness and interest in the subject of "fair use."

“Trademarks and Keyword Advertising:  Fair Use on The Web”

Program Topic:
Trademarks and Keyword Advertising:  Fair Use on The Web

Description:
The presentation will begin with a mock oral argument focusing on keyword ads appearing on a search engine.  Parties represented in the argument will include the trademark owner, the search engine, and various advertisers, including competitors and critics of the trademark owner.  The hosts will then lead a discussion to highlight issues raised by courts in these types of cases, including whether keying ads to trademark terms constitutes trademark use, whether such ads create a likelihood of confusion (including initial interest confusion), and the role of defenses such as fair use and nominative use.  Written materials will be distributed at the meeting.
